Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the website located at disciplinedhiringsystem.com (the “Site”) or purchasing any products or services offered by Disciplined Hiring System™ (“DHS,” “we,” “us,” or “our”). By accessing the Site or purchasing our products or services, you (“Client” or “you”) agree to be bound by these Terms. If you do not agree, do not use the Site or purchase our products or services.

1. Services Offered

Disciplined Hiring System™ offers structured hiring frameworks, implementation coaching, templates, and related resources designed to help small businesses improve their hiring processes. Our current offerings include:

Core Implementation — a one-time purchase that includes the full Disciplined Hiring Framework document set, templates, evaluation tools, and up to one facilitator-led orientation session (up to 3 hours) and one follow-up Q&A session (1 hour) within 30 days of purchase.
Executive Implementation — a one-time purchase that includes everything in Core Implementation plus six weekly 90-minute coaching calls, live walkthroughs with your leadership team, and direct facilitator access during the implementation period.
Free resources, including the Hiring Readiness Assessment and other downloadable materials available through the Site.

We reserve the right to modify, suspend, or discontinue any product or service at any time without prior notice.

2. Purchases and Payment

2.1 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. The price displayed at the time of your purchase is the price you will be charged.

2.2 Payment

Payment is due in full at the time of purchase. We accept payment methods as displayed at checkout. All transactions are processed through secure third-party payment processors. By submitting a purchase, you represent that you are authorized to use the payment method provided.

2.3 Taxes

You are responsible for any applicable sales taxes, use taxes, or similar charges associated with your purchase. Where required by law, DHS will collect and remit applicable taxes.

3. Refund and Cancellation Policy

3.1 Digital Products and Framework Materials

Because our Core and Executive Implementation packages include immediate access to proprietary digital framework documents, templates, and materials upon purchase, all sales are final. We do not offer refunds once access to framework materials has been delivered.

3.2 Coaching Sessions

Scheduled coaching or orientation sessions may be rescheduled with at least 48 hours’ advance notice. Sessions cancelled with less than 48 hours’ notice or missed without notice are forfeited and are not eligible for rescheduling or refund.

3.3 Exceptions

If you believe an exceptional circumstance warrants a review of this policy, please contact us within 7 days of purchase. We will review such requests at our sole discretion. Approval of any exception is not guaranteed and does not set a precedent for future requests.

4. Intellectual Property

4.1 Ownership

All content on the Site and all materials delivered as part of our products and services—including but not limited to the Disciplined Hiring Framework, job description templates, interview scorecards, screening rubrics, evaluation tools, written guides, and all associated documentation—are the proprietary intellectual property of Disciplined Hiring System™ and are protected by copyright, trademark, and other applicable intellectual property laws.

4.2 License to Use

Upon purchase, DHS grants you a limited, non-exclusive, non-transferable license to use the delivered materials internally within your organization for the purpose of improving your hiring processes. This license does not permit you to:

Reproduce, copy, or distribute the materials to third parties outside your organization
Resell, sublicense, or otherwise commercialize the materials
Use the materials to create competing products, training programs, or consulting services
Remove or alter any proprietary notices, trademarks, or branding from the materials

4.3 Trademark

“Disciplined Hiring System™” and associated logos and marks are trademarks of DHS. You may not use our trademarks without our prior written consent.

5. Client Responsibilities

By purchasing our products or services, you agree to:

Provide accurate and complete information when booking calls, completing assessments, or communicating with us
Attend scheduled sessions on time and come prepared
Use the materials and framework in good faith and in accordance with these Terms
Ensure that your use of the materials complies with all applicable employment and labor laws in your jurisdiction

You acknowledge that the Disciplined Hiring System™ is an operational framework and does not constitute legal, human resources, or employment law advice. You are solely responsible for ensuring your hiring practices comply with applicable law.

6. Disclaimer of Warranties

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DHS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from the use of our products or services, including but not limited to specific improvements in hiring quality, employee retention rates, or financial outcomes.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DHS AND ITS OWNERS, OPERATORS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

8. Indemnification

You agree to indemnify, defend, and hold harmless Disciplined Hiring System™ and its owners, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Site, products, or services; (b) your violation of these Terms; (c) your hiring decisions or employment practices; or (d) any claim that your use of the materials infringes the rights of a third party.

9. Third-Party Links and Tools

The Site may contain links to third-party websites, scheduling platforms, and payment processors. These links are provided for your convenience only. DHS does not endorse or assume responsibility for the content, privacy practices, or terms of any third-party sites. Your use of third-party services is governed solely by their respective terms and policies.

10. Strategy Calls

Strategy calls are offered as a free, no-obligation consultation to help prospective clients determine which product or service is appropriate for their needs. Participation in a strategy call does not create a contractual obligation for either party. DHS reserves the right to decline to schedule or continue a strategy call at its discretion.

11. Confidentiality

In the course of our engagement, you may share confidential business information with DHS, including information about your workforce, hiring challenges, and organizational structure. We will treat such information as confidential and will not disclose it to third parties except as required by law or as necessary to deliver our services.

Similarly, the proprietary materials, frameworks, and methodologies we deliver to you are confidential and proprietary to DHS. You agree to maintain their confidentiality and not disclose them to competitors or use them to develop competing offerings.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site or services shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Ashland County, Ohio.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.

13. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the “Effective Date” at the top of this page. Your continued use of the Site or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Entire Agreement

These Terms, together with our Privacy Policy and any written agreements executed in connection with your purchase, constitute the entire agreement between you and DHS with respect to your use of the Site and purchase of our products and services. They supersede all prior discussions, representations, and agreements between the parties on these subjects.
